In Maharashtra, redevelopment of a co-operative housing society follows the directions issued by the State Government under Section 79A of the Maharashtra Co-operative Societies Act, 1960. They cover the general body meetings, appointment of consultants, the tender process for selecting a developer, and member approvals.
The society transfers the share and interest on the basis of the nomination, a will, or the legal heirs' documents, under its bye-laws. Depending on the facts, it may ask for probate, a succession certificate, or indemnities and no-objections from the other heirs.
